The redesignation provides temporary protection from removal as well as employment authorization (“EAD”) for individuals in the United States before July 31st 2023. Venenzuelans who have arrived to the United States after July 31st 2023 are not eligible for such protection, and instead could be removed if they are found to not have a legal basis to stay. The United States and Immigration Services will continue to process pending applications filed under TPS .
If USCIS approves a pending Form I-821 or Form I-765 filled under the previous designation of TPS for Venezuela. USCIS will grant the individuals TPS and issue and EAD valid through the same date. Eligible individuals who do not have TPS may submit a Form I-821 Application for Temporary Protected Status during the initial registration period. Applicants may also apply for TPS related EADs and travel authorization.
