Important TPS Update for Haitian Nationals 📣🇭🇹‼️

Last night, a federal judge blocked the Trump administration from ending Temporary Protected Status (TPS) for Haiti, which had been scheduled to expire on February 3, 2026. This ruling provides immediate relief to Haitian TPS holders and keeps current protections in place while the case moves forward.

The decision came from a class-action lawsuit, Miot v. Trump, in which the court ruled that the Department of Homeland Security’s attempt to terminate Haiti’s TPS designation is “null, void, and of no legal effect” during the litigation.

As a result, Haitian nationals with TPS remain lawfully protected. ✅🙌🏿

At this time, TPS beneficiaries remain protected from detention and deportation, and existing Employment Authorization Documents (work permits) remain valid. The court made clear that work authorization is not impacted by the attempted termination.

The judge found that DHS likely acted unlawfully by failing to fully consider Haiti’s ongoing humanitarian crises, including widespread violence, mass displacement, economic instability, and the lack of a functioning government. The court concluded that the termination decision was likely arbitrary and unlawful under federal administrative law.

While the government is expected to appeal, TPS protections for Haitian nationals remain in effect unless a higher court rules otherwise. Even if USCIS or DHS websites still display termination notices, the court order controls and overrides those announcements for now.

On December 12, 2025, the Department of Homeland Security (DHS) announced that it is ending the Family Reunification Parole (FRP) programs for individuals from Colombia, Cuba, Ecuador, El Salvador, Guatemala, Haiti, and Honduras. Going forward, parole will be granted only on a case-by-case basis.

If you entered the U.S. under an FRP program and your parole is still valid on January 14, 2026, it will end on that date unless you filed a Form I-485 (application to adjust status) by December 15, 2025, and that application is still pending.

If your Form I-485 is pending, your parole will remain valid until DHS makes a decision or your parole expires—whichever comes first. If the application is denied, your parole will end, and you may be required to leave the U.S.
Once parole ends, DHS will also revoke any work authorization tied to that parole. Affected individuals will receive notice directly from DHS.
